Occupational Health and Safety Act 85 of 1993 – Legal Liability for South African Companies

• An employer who fails to ensure compliance with the Occupational Health and Safety Act faces fines of up to R50 000.00, or one year imprisonment. 
• An employer found guilty of negligently causing injury to a worker faces a fine of R100 000 or two years imprisonment. In the event of the accidental death of an employee, the employer faces a charge of culpable homicide, which carries a penalty of at least 15 years imprisonment.
